Consumer Protection
Unfortunately, most consumers are unaware of both State and Federal Laws that protect them against abusive lenders, businesses, credit card banks, and debt collectors.  If you have been sued by a credit card, a debt collector (or debt buyer), a bank, or have been lied to, defrauded, deceived, abused and harassed by either a debt collector or business (small businesses, large businesses, car dealers, etc.,) contact us for a free consultation.

Credit Card Defense and the FDCPA (Fair Debt Collection Practices Act)

If you have been sued by a bank under a credit card agreement (Citibank, Comenity Bank, Discover Bank, American Express Bank, etc.,) or one of the many debt collection/buyer outfits (CACH, Cavalry, Portfolio, Unifund, Superior Debt, etc.,) contact our office immediately.  The debt buying and credit card industry don't want you to know all the protections provided to you under State and Federal Consumer Protection Laws.  Many of these lawsuits are very difficult for the banks or debt buyers to prevail on because they are almost always missing proper documentation to sue.  Furthermore, if they have violated your rights under the Fair Debt Collection Practices Act (FDCPA) or the Florida Consumer Collection Practices Act (FCCPA), you may have the right to sue the bank or debt collector right back possibly resulting in the underlying lawsuit against you to be dismissed and potentially put money back in your pocket.

Unfair and Deceptive Business Practices

Florida provides powerful protection under the Florida Deceptive and Unfair Trade Practices Act (FDUTPA).  If you believe that a business has treated you unfairly or deceptively, you may be able to sue the business for money damages.  Furthermore, Florida Law states that if you sue a business under FDUTPA and win, the losing party will also have to pay my attorney's fees as well.  Please call us for a free consultation in order to evaluate your case.
